Terms of Service

1. Acceptance of Terms
By accessing or using VibePivot ("the Service," "we," "our"), you agree to be bound by these Terms of Service. VibePivot is a music discovery interface powered by the iTunes Search API and other third-party services. If you do not agree to these terms, do not use the Service.
2. The Discovery Trial (Swipe Limits)
Guest Access
Unregistered users are granted a limited number of free Vibe Swipes per session to test the discovery engine. This limit exists to protect the quality of the recommendation system and to comply with third-party API usage policies.
Account Requirement
Accessing Power Features requires a verified account via Spotify, Google, or Apple. Power Features include, but are not limited to:
- Creating and managing custom genre categories
- Seeding discovery from external URLs or playlists
- Unlimited swiping and taste profile persistence
- Cross-device sync of your Vibe History
Creating an account is free. We do not require a credit card or subscription to use core discovery features.
3. Content Disclaimer
VibePivot does not host, store, or stream music files. All 30-second audio previews are served directly by the iTunes Search API under Apple's public API terms. Full track playback is facilitated via redirects to third-party platforms (Spotify, Apple Music, etc.). VibePivot is not responsible for the availability, licensing, or accuracy of this content.
Track metadata (title, artist, genre, BPM estimates) is sourced from public APIs and may contain inaccuracies. BPM values displayed are algorithmic estimates, not authoritative measurements.
4. User Conduct
You agree not to:
- Use automated scripts, bots, or crawlers to scrape BPM data, artist metadata, or recommendation outputs from the platform
- Attempt to bypass the guest swipe limit via technical manipulation (cookie clearing, VPN rotation, etc.)
- Reverse-engineer the recommendation algorithm or resell its outputs
- Impersonate other users or use another person's credentials
Violations may result in rate limiting, IP restrictions, or account termination at our sole discretion.
5. Intellectual Property
The VibePivot interface, design system, and recommendation logic are our proprietary work. Track artwork, audio, and metadata belong to their respective rights holders. No content on this platform implies endorsement by or affiliation with Apple, Spotify, or Google.
6. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of VibePivot or any third-party content accessed through it.
7. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will note the revision date at the top of this page.
